Update on the Department of Education’s proposed Title IX regulations at WFU
Update: On January 9, 2025, a federal judge struck down the 2024 Title IX regulations in their entirety. Unlike the previous injunction, this ruling applies nationwide and has effectively restored the 2020 regulations for all institutions. On January 31, 2025, the Department of Education confirmed that it will resume enforcement of the 2020 regulations. As a result, Wake Forest’s 2020 Title IX & Non-Title IX Sexual Misconduct Policy and Grievance Procedures will remain in effect.
In May, theUniversity announced that the U.S. Department of Education had recently published new Title IX regulations regarding sex-based discrimination and harassment. Wake Forest formed a task force to revise Wake Forest University’s policy and procedures to comply with these regulations. As a result of several legal challenges to the rules, a federal district court in Kansas issued an order on July 2, 2024, that prohibits the Department of Education from enforcing the new regulations in four states and at nearly 700 schools, including Wake Forest. As a result of the court order, theTitle IX & Non-Title IX Sexual Misconduct Policy & Grievance Procedures will remain in effect until further notice.
This decision to pause does not change the University’s steadfast commitment to providing an education and workplace environment free from sex discrimination and harassment. Wake Forest strongly encourages all employees and other members of the Wake Forest community topromptly report concerns regarding suspected or known discrimination, harassment, or misconduct on the basis of sex or gender to theTitle IX Coordinator Wake Forest’s completeprogram of resources, including supportive measures, training and prevention programs, and reporting options remain fully available.
